Question:

What evidence can I use to build my case after a traffic accident?

Answer:

Traffic accidents can give rise to a great deal of financial loss. In all but 12 states, that financial loss is supposed to be compensated by the person who is at fault for the car accident. The damages that the responsible or negligent party will have to pay after an accident include damages for medical bills, lost wages, pain and suffering, emotional distress and property damage, among others. The problem is, you have to prove that the other party actually was responsible and should pay. To do this, it is essential you collect the right evidence. Evidence to collect after a traffic accident includes:

  • A police report about the accident, often referred to as an incident or accident report. This should contain as much information as possible, including the officer's assessment of what occurred and details about whether any traffic citations were issued to either party or not.
  • Photos from the scene of the accident showing the two cars, and the location of any road debris. If there are tracks or marks on the road, those should be photographed too. If you have suffered any injuries, you will also want to make sure to take photographic evidence of those injuries
  • Statements from any witnesses to the scene of the accident who may be able to clear things up if it becomes your word against the word of the other driver.

In some instances, expert witnesses are also hired to help reconstruct the events of the accident. In any case, you will want to get a lawyer after the accident in order to make sure you are able to collect the evidence you need and build your case.
