I was rear ended in just over two years ago. I have been in pain ever since. I have sought treatment in several different areas (chiropractic, etc etc). No one seems to be able to explain what the injury actually is and why it continues to be such a problem. The insurance company of the driver at fault, has accepted responsibility (I have this in an email from them) and has reimbursed me for my vehicle which was totalled. I am in pain every day, all day. I am self employed so there is no option to not work, so I have to take pain medications several times each morning to get the pain under control to at least a tolerable level so I can work. This usually takes 4-5 hours. This is every single day. Fortunately I work from home so I can work when I am able to do so.
The insurance company now tells me that since the statute of limitations was 2 years and now it is too late and they won't pay any of my medical expenses. I asked several times if I could be reimbursed for the costs I have paid out of pocket and their response was always "We cannot pay the claim until treatment is complete." (I have this in an email also) These were their words. Well treatment is not complete. Isn't that a verbal contract? I have been sending in my receipts as they were incurred. As I was never told about the statute, nor was I ever given an option to settle, how is this right? If they had been willing to settle, I would have done so a long time ago, but they kept telling that they cannot settle until treatment is complete.
Any advice or suggestions would be very much appreciated. I have thus far spent almost $12,000 on medical bills alone. This does not include the extra time I have to pay others to do what I can no longer manage, all the pillows, devices, etc that I thought may help, nor does it include any amount for the constant pain I have been in for two years.
I really need some help here. My condition has not even been fully diagnosed, but I would be willing to settle the matter and take responsibility for future medical bills if that is what needs to happen.

It sound like typical insurance company run-around. While you may be barred from certain compensation due to the statute of limitations having expired, you should still have access to compensation for medical costs that you've incurred.
