Question:

A lady lost control of her car and hit me head on in my lane.  The insurance had given me a check for my car that was totaled, and has paid for some of my medical bills.  They told me they would pay for the time I had to take off work, but have not yet.  They want to settle, but I am still being treated.  My doctor wanted me to wait about 30 days between visits while I do electrical shock treatment at home, and now the insurance is saying that is to long to wait between visits, so they say they don't need to pay those medical bills.  I am having a hard time working, as my job is labor intensive, and it is sometimes painful to even work part of my shift.

What can I do?

Answer:

You have every legal right to wait as long as is necessary (within reason) to ensure all of your related medical expenses are taken care of by the negligent parties insurance company. Trying to force you to settle quickly is a common insurance company tactic, so that they can avoid paying some of your expenses.
