Question:

As a result of a car accident I suffered terrible whiplash. Can I be reimbursed for chiropractic expenses?

Answer:

When you are in any type of car accident, your ability to be reimbursed for medical treatment and other damages depends both on where you live and on who was responsible for the accident. As such, whether or not you are eligible for whiplash car accident insurance re-imbursment is going to depend on these factors.

  • The first thing to consider is whether you live in a fault state or a no fault state. If you live in a no fault state, then your own insurance company is going to provide you with broad protection for your injuries, no matter who caused the accident. This means if you hit someone, or if they hit you, you're still going to be getting your medical expenses paid by the insurance. This can include medical expenses for chiropractic care, as long as you go to a legitimate physician and he documents the care and costs of the car so that this can be submitted to the insurer for reimbursement
  • If you don't live in a no fault state, things get trickier. In this case, whomever was responsible for the accident is also responsible for paying the costs. If you yourself was responsible, then you may not be able to be reimbursed for anything at all. It depends on whether you have coverage that will provide reimbursement (aka, you'd need medical injury protection coverage of some type to get reimbursed for this). Of course, if the other party was responsible, that means he's going to be paying your bills. The money you get form him, either through an in-court jury verdict or out-of-court settlement- should be enough to compensate you not only for your chiropractic expenses, but also for missed work, other expenses and pain and suffering.

To get help determining if you are covered or not, and how to pursue a claim, you should strongly consider speaking with a lawyer for help.
