Can I get PIP compensation after a car accident?

Answer:

Car accident pip compensation is a special type of compensation available through your own insurance company. Whether or not you can receive PIP compensation depends on whether you purchased this type of policy protection when you bought insurance coverage. 

In twelve of the states in the US, PIP protection is standard and required on most car insurance policies. These states, referred to as no fault states, require you to purchase no fault insurance when you buy car insurance. The no fault insurance is also referred to as a personal injury protection (PIP) policy. Under PIP:

  • Any driver who is in a car accident, regardless of who is at fault, is entitled to make a claim for his damages from that car accident
  • The PIP claim will pay for medical bills and lost wages that occur as a result of car accident injuries. The amount paid will be based on actual expenses, state law (i.e. some states require 100 percent coverage while others allow for a percentage of lost wages) and your policy limits
  • A person who suffers car accident injuries that are not deemed "serious" under the law will only be able to recover through PIP. He will not be able to sue, and he will not be able to receive compensation for pain and suffering or emotional distress. 

It is also important to note that in certain states, including Pennsylvania, choice no fault rules are in place. This means you may purchase PIP coverage and if you do, you will neither be able to sue or be sued as a result of a car accident that occurs where the injuries are not defined as serious.
