Fair Compensation in Medical Payment Claims
Medical payment claims from insurance companies or parties are rarely as large as anticipated. Fair compensation for such claims is dependent on the documentation and expected future required visits. Below is an explanation of the calculation of medical payment claims, an amount of payment that is acceptable for such claims.
Calculation of Compensation
Medical payments are made based on the calculations provided by the injured party. These calculations must derive from receipts and other documentation of the expenses associated with the medical treatment sought. If some of the costs have been paid for entirely or in part by the party’s health insurance only the part actually paid by the injured party can be included in the calculation.
Many things not covered by health insurance should be included in your calculations. Prescriptions, massages or any other medically related expenses should be included. Visits to a chiropractor, products purchased to assist with your pain or to correct the injury should also be added to your calculations.
Future Costs
It is much harder to calculate anticipated future medical expenses because they are unknown. However, if any future costs are in any way expected those amounts should be included in the claim. These amounts can be estimated by your attorney or your medical professionals. A good rule of thumb is to overestimate the amount of future expenses to make sure that there will be ample funds available when they are needed.
Pain and Suffering
Although it can be, pain and suffering is not usually included in medical payments. This calculation is typically separated from other medical costs and clearly identified as intended for past and future pain and suffering.
Insurance Company Adjustment
The sad truth is that the insurance company will most likely not pay you the full amount of your claim, but will instead adjust the amount you request to an amount it thinks that you should pay. This amount is not a final amount; you should negotiate this amount to get it as high as possible. Do not accept an offer that does not even cover you documented costs to date and the bare minimum of your anticipated future expenses.
Getting Legal Help
If you have been injured in an automobile accident, seek legal assistance with your claim. An attorney will be able to calculate and estimate how much compensation for your injury you should claim and reasonably expect to receive.
